Terms of service
Plain-language terms for using Nyamly as a customer. Merchant and courier agreements are provided during onboarding.

1. Who we are and what this covers
Nyamly operates an online marketplace where customers order food, groceries and other goods from independent merchants for delivery by independent couriers or for pickup. These terms govern your use of the Nyamly website, web apps and mobile apps (together, the "Service"). The Nyamly entity you contract with is the one registered in the island market you order from; it is named on your receipts and on the Trust & Safety page.
2. Accounts
You must be at least 18 to create an account. Keep your sign-in details private and tell us straight away if you think someone else is using your account. You are responsible for orders placed from your account until you tell us otherwise.
3. Placing an order
When you place an order you make an offer to buy the listed items from the merchant, and to buy a delivery service from us where you choose delivery. The order is accepted when the merchant confirms it. Until then you may cancel without charge. After the merchant starts preparing the order, cancellation may result in the full charge because the food has been made.
4. Prices, fees and currency
All prices are shown and charged in the currency of the island market you order from. Any other currency shown is an estimate for information only. Before you place an order we itemise the item subtotal, delivery fee, service fee, any small-order fee, applicable tax and the tip you choose. Demand-based surcharges are shown as a separate line with their limit. Merchants set item prices; Nyamly sets delivery and service fees.
5. Payment
Payment is taken by a licensed payment provider for your market; Nyamly does not store full card numbers. Where cash on delivery is offered, the amount to hand to the courier is shown at checkout and rounded to the smallest local coin. Refunds go back to the original payment method or, if you prefer, to Nyamly credits.
6. Delivery
Couriers deliver to the location you confirm on the map, using the directions you provide. Some orders require a delivery PIN or a photo as proof of delivery. If you are not available and cannot be reached, the courier will follow your drop-off instructions or, if that is not possible, return the order; a redelivery fee may apply.
7. Problems with an order
If an item is missing, wrong or damaged, report it from the order within 48 hours. We may ask for a photo. Item-level refunds are usually issued automatically. Repeated claims may require additional verification.
8. Your conduct
Do not abuse merchants, couriers or staff; do not use the Service for anything unlawful; do not try to circumvent delivery PINs, payment or fraud controls. We may suspend or close accounts that do.
9. Merchants and couriers
Merchants and couriers are independent businesses and individuals, not employees of Nyamly. Their use of the Service is governed by separate partner agreements.
10. Our liability
We are responsible for providing the Service with reasonable care. We are not liable for losses that were not foreseeable, for merchants' food safety obligations, or for events outside our reasonable control such as weather, road closures or network outages. Nothing in these terms limits liability that cannot be limited under the law of your market.
11. Changes
We may update these terms. If a change matters to you, we will tell you in the app or by email before it takes effect. The version that applies to an order is the one in force when the order was placed; the version number is on this page.
12. Law and disputes
These terms are governed by the law of the island market you order from. Contact support first; most issues are resolved there. If not, you may bring a claim in the courts of that market.
